Topic: Photos used for promo...

I was cruising through a few sites to see if there were fan photos being used.  What prompted me to browse was a reservation flyer from Crystal Bay had one of my photos.

Well, I found one of mine here:  http://www.fireonthemountain.com/blues.html  At least this one is not distorted like the newspaper that used it.

I thought it was very cool and was curious if other fan photographers were getting their photos displayed?  Melissa?  Joanie?  Pierre?

Well, I'm on Schmap with 10 photos (only one of Joe) and am regularly published in BlueInk. I've seen some of my Joe photos on various websites, but none of them have a way to contact them. Make sure you email the website using your images and get credit! If need be, change your license on your Flickr account. Make them contact you prior to use.

I also have many non-music photos on other websites, including one for a macro tutorial I wrote. But those are ones I've given permission on. The simple truth is, we own the rights to our images, but we are often somewhat stuck when it comes to preventing others from using them. UNLESS, of course, you watermark the images. The only effective means of doing this will prevent people from seeing the image completely, but that's a choice you have to make.

It wasn't my photograph, but I did receive a copy of a Netherlands publication (which I can't read for the most part) but it appears to be a listing of musical performances for several different clubs. It was from when Joe was on tour in Europe in 2005, and Tony B was nice enough send it to me. Anyway, the photo for Joe's upcoming show was one of Garth's photographs! What was also very cool was the first sentence below the photograph, which read: "'Have you told anyone about Joe Bonamassa today?' is de slogan van de Bonamassa-fansite." I thought that was pretty cool...

The way the copyright policy reads, Joe and Premier do have rights over the images, but the photographer still maintains the creative copyright. It's rather complicated, but the simple fact is - we don't own Joe's image rights, but we do own rights to our photos as creative product.

Hard to explain all the technicalities of how it all works, but my resident attorney at BC took a look at it for me a and that's what she's come up with. Again, this is one attorney's view of the situation.

The big thing to remember is that none of us should be looking to make money off of photos we take or recordings we make of the Joe Bonamassa Band. As long as no one is doing that, we're all okay. And websites looking to use images we've taken should, out of professional courtesy, ask the photographer's permission and attribute the images accordingly.
