Here is the thing.
Fender can make their paint jobs look however they want as long as they don't put a sig. name on it. It will be easy to prove that there are subtle differences in the two paint jobs that make the Fender production model "unique" and that their reproductions far outweigh the 1 original that is in question.
I'm not a lawyer, but I do have Master's in Graphic Design. I can guess that the only way to protect this from happening is to copyright the image and likeness of the guitar. This means painstakingly mapping the imagery of the guitar. Each guitar you have if you want none of them ripped off. If the image and likeness of the guitar is protected by law, you would still have a hard time getting any legal or monetary compensation for taking action against questionable duplicates.
Exactly. try to sell anything today with Black and white stripes. EVH's lawyers will be calling.
It's pretty obvious that Fender is ripping Phillip's #1 Strat here. You would think they would've learned their lesson with Joe....

I honestly feel for Phil cause I know the feeling. This shows the levels of Fender's nonsense.... They copied my guitar and now Phil's. They do it to guys in certain stages of their careers when they feel " What are they gonna do?" Again there is a reason for all my anti Fender stuff around here. As you can see.

The guys in Fender's are an intresting group....
Question for Joe, did you ever talk to G&L about building your strat? They make a better Strat than fender does hands down and I am sure they would of loved to have someone like you using one of there guitars. By the way the Phoneix show was amazing!
If I ever do buy another Strat It will be a G&L.
holy bloody crap... ...I do love Fender guitars, but they really give me a hard time to do still... that's just not fair and on the long run they only will damage their reputation by themself... Don't they think about the fact that in these days such things are spread across the world within seconds sometimes... it sucks...
however I am more on the Gibson side already anyway...

Obviously it is all about the bottom line at Fender. No respect or regard for the time and sweat Joe and Philip put into their guitar skills and the "free" advertising they have given Fender over the years. For what it is worth, I have two strats collecting dust and a Les Paul Custom I am almost sleeping with. Something really stinks at Fender right now and it has to come back and bite them in the rear end one of these days.
The best thing anyone can do who plays a Strat (myself included) is to just remember that you play them because you like them, not because of the company's upstanding character, which there clearly is none. That's okay, I'm really wanting a Gretsch right now.
Fender really is screwing themself for the future. Someday, not to sound real morbid or anything, guys like Eric Clapton, Buddy Guy, Robert Cray, etc won't be around to carry the torch. Also, current endorsees may "die off" like a fad. They gave Tom frickin' Delonge a signature Stratocaster for crying out loud...now look at how many of his guitars are flying off the shelf. Will John Mayer still be popular in 20 years? I think when his youth and power over the younger female crowd leaves him it will kind of make his music more...creepy. I'm not doggin' the guy, I have some of his albums, but a 50 year old Mayer singing "Your Body is a Wonderland" gives me nightmares!
I guess my point is that guess like Phil and Joe have music that can stand the test of time. Blues/rock is a great thing to invest in, especially given the long time endorsees of both Gibson and Fender. Either way, I'll always own a Stratocaster because it's just part of who I am. I love their tone and versatility.

I really don't understand it. Why do Fender risk this stuff?! I mean, can they not think of wearing themselves, they have to wear in exactly the same places as someone elses guitar and risk a lawsuit.
This is why I have steadily sold off all my Fender equipment. With the exception of a 65 Super Reverb...I no longer play through any Fender. I guess it is silly of me...but now they have short changed two of my favorite guitarists. I pretty much only play my Les Pauls through amps I have built. I have decided to try (emphasis on try) to only support the music business where I agree with the way they operate...and I generally only buy used at my local guitar shop. I do play strat-like guitars because I like them and I have modified them, but they are not Fender.
Sheesh...I am becoming a curmudgeon.
The reality is that lawyers and MBA's are running the "business" part of this industry. Regardless of how it makes anyone feel, the money will be made and it will be made off of us (the consumers) and the artists. With or without us approving. I don't care what industry we discuss they all have this aspect to them and they are rarely warm and fuzzy types writing the contracts.
No offense to the lawyers or MBA's on here but these folks generaly have egos bigger than the companies they run. And they NEVER care what we think.......these are the folks that tell you over and over again "it's just business."
And I agree, Gibson makes a better instrument.......
been saving hard for couple of years for a PRS David Grissom (It will be mine oh yes it will be mine). Like someone else said fender and gibson are profit driven companies and I think PRS is the only of the big 3 that really care about what they are doing. Anyone read the interview with Paul reed smith in guitarist this month? He truly cares about what he is doing and after 25 years still has the drive to do it and keep moving forward while remaining traditional to what guitarists want. Gibson dark fire/dusk tiger or VG strat anyone?

When PRS started making SE models... that was a step in the money hungry, lower quality direction
When PRS started making class a tube maps boutique style and over priced.... hands in more baskets.
When PRS started making high priced acoustics..... hands in more baskets.
Is making a GREAT solidbody electric guitar in America "enough" for a company anymore?
