Why is Joe using a strat here???

sometimes if you record a track with a certain guitar the only true way of sounding exact live is using the same guitar

A strat has a tremolo system that the les paul hasn't also the position of the volume is different so he can use that as an effect

Sometimes when i play i will take 2 maybe even 3 different guitars with me as they all sound different

Joe played a vintage Strat on the 2006/2007 tour when performing Django. Joe still owns many vintage Fender guitars and amps. He is not a Fender endorsee however. Joe has nothing against vintage Fender products.

I beleive it was in 2006 that he first toured with Gibsons and Gigliotti's almost exclusively. It was after You and Me was recorded. Gibson had the vision that Fender seemed to lack that Joe would be a influential player to many. He was signed to Gibson and the inspired by model soon followed.

Not sure if you are saying that Joe played a Strat in Italy or if you think you saw him play one. Unless he played Django which has not been in the setlist this tour it probably wasn't. He has been playing a Gigliotti in Europe on John Henry which does look like a Fender.

You say trial did he get sued or something by Fender?
