Topic: You Tube video muted by Copyright owner

OK folks, I always like to play clean and post videos of Joes performances and unrelated videos with Joe's tracks on the back of them with credits and promotions in line with the stated policy published on here. Some years ago, before the present request for publicity for J&R existed, I posted a video about a shark dive i filmed in the Bahamas, with Joe's version of "Tea for One" on the back. It's played happily for many years  to anyone who chose to view it. Now I was showing it to a couple of friends today on my Android phone and it played fine, but when I got home from work I was greated by the following e-mail from YouTube.

Dear Geoff Oldfield,
Your video "Bahamas Shark Dive", may have content that is owned or licensed by INgrooves. As a result, the video’s audio has been muted.
Visit your Copyright Notice page for more details on the policy applied to your video.

I don't know whether that has coincided with a very recent upgrade that You Tube have made to their server, but it was most unwelcome as you can expect. I can only assume that the original copyright owner rather than Joe's policy maagement have launched this injunction.

However, on further investigation I find that J&R are in fact new label partner  http://www.ingrooves.com/our-label-partners/
So maybe it is Joe's (or more likely Roy's) decision to reign in the use of Joe's material.

Furthermore, upon querying the claim, the following questions are asked

I believe that this copyright claim is not valid, because:

I own the CD/DVD or bought the song online.

I'm not selling the video or making any money from it.

I gave credit in the video.

The video is my original content and I own all of the rights to it.

I have a licence or written permission from the proper rights holder to use this material.

My use of the content meets the legal requirements for fair use or fair dealing under applicable copyright laws.

The content is in the public domain or is not eligible for copyright protection.


All of which are tick box questions (you can only tick one) I tried to tick several but had to opt for "I gave credit in the video (comments section) and the reply........


"Giving credit does not give you authorisation to upload the content. Even if you never claimed to own the copyright or gave the copyright owner credit, posting these videos on YouTube may violate copyright law."

So it seems things are changing.

I've seen quite a few old and much watched vids deleted by youtube lately. A couple had over a million views. I get notices of stuff like that every morning with one of my search engines.  New software roaming the net and killing stuff?

I get together with some friends twice a year and we jam all day long to a pre-planed set list.  We did versions of Pearl Jam's Alive and ZZ Top's cheap sunglasses.  The guy that posted our cover versions to youtube, along w/ song titles, received copyright/warning emails from youtube!  It seems as if nothing is fair use anymore.  He posted additional videos either with variations of the band name/song title or nothing at all.  So far the youtube police hasn't hauled him away!

I do understand that it's an automated thing. I have "matched third party content" notifications on quite a few of the videos on my Chanel. It's just that this is the first heavy handed tactic of blocking content I have had and it was instigated on behalf of the one person in the industry who has the most enlightened view over content awareness promotion. Not only was I surprised, I was shocked!

Shocked? Yes & hurt!  This might be a first; I would never publicly disagree with Joe/Roy but without knowing more...after all the time that's been up?  Call down there and ask about it.  Maybe special dispensation?  Maybe that's a line they don't want crossed.  Hell I dunno, mate.  Seems a bit impersonal...

It seems to me they were justified in pulling it because it is an officially released song that Joe makes money off of and you gave no credit to Joe in your description of the video or any link to his website. You may have said something in a comment, but that is not part of the video description.
I believe it is also wrong when people pull clips off of official DVDs like Rockpalast and RAH and put them up on their youtube channels with no credit to where they got it from or link to Joe's website and youtube channel, and pass it off like it is their recording. Whether or not they're making money off of them it is still Joe's official release and they are basically stealing it.

I think you're right Natasha. I will publish it again, but with all the attendant promotional bits and bobs on there and drop a note to Roy to see if there is any feedback. I know you were contacted only recently by Joe's team, requesting that you place promo info on your own postings of performances, which helps advise the viewing public of how they can find out more info. Back when I put that video together, there were no such requests and I guess Joe was kinda chuffed that his music was getting out there. Like you I am a huge Joe fan, and have been since the album this song came from was first released. I have promoted Joe heavily since that day and continue to do so.

Natasha is correct I believe. I didn't even think about that but have been in the habit of putting that little line on the vid saying to look at the description since I started doing the contests and that is the way J&R want it. I do the same for any artist I happen to shoot now and have had no problems, even when it is flagged as non owned by the yt engine. I've only had to take down one vid of mine and that was by personal request of the musician and only one of three songs from that show I'd put up but he didn't like that performance I guess. It was a good vid but I yankied it and apologized, he nicely responded with an acknowledgement. 
A lesson for all here.

This isn't directed at JB and team specifically, but I hope artists and their management teams don't lose sight of the promotional power of Youtube. Youtube is directly responsible for more of my music purchases over the past few years than TV, radio, Pandora and Spotify combined...and I suspect I'm not alone in this.

It  seems the music biz gets more complex every day.I'm sure it's a balancing act of promotion and trying to protect the product so some money can be made.JR seem to always have the right intentions in regards to the fans.

You have to be honest and admit the possibilities of YouTube also having the power of empowerment for today's pirates with lowered pants to never buy a download, hard copy, pay per view, or concert ticket...it does work both ways and neither way is a certainty of desired result...

Build it, and they will come.  Build it with no security, it and the "spoils" will fall into other hands.  neutral

But I am in agreement, personally, Stu.  You Tube IS, for me also, the bigger influence of the others, and yes, combined.  Of course, I'd have to separate current from retro, but it still pans out the same.  I can imagine for some artists
it has to be like a Charts, Graphs, and Stats graduate class, and could become like watching a stock ticker...yiiiiiii yikes

Well, I wrote to Roy and he responded saying he will see what he can do. Nothing has changed yet so I've notified the You Tube team that they should contact Roy Weisman at J&R Adventures. Lets just hope that doesn't shut my whole youtube chanel down.
